Dear Mayor and Council Members:

We wish to respectfully submit our desire for you to overturn the Planning Commission's decision to deny CUPs to the above referenced applicants.

It appears that the members of The Planning Commission for the City of Avalon is denying CUPs for the majority of the applicants when the applicant meets all requirements for approval. The members of the Planning Commission, while appointed, must uphold Avalon's Municipal Codes.

The number of denials to applicants who have met criteria for CUPs and been denied is growing. We would suggest that the Council meet with the Planning Commission and discuss the fiduciary responsibility to the City, that member(s) should be asked to resign.

It would be very easy for these applicants to not apply for a CUP and cheat the City out of the TOT. They are trying to go the "legal" route, pay their tax and are getting denied unfairly.

As our elected officials, it is your fiduicary responsibility to make certain members of the Planning Commission are not being discriminatory and are consistent and nondiscriminatory with these applicants. It would appear applicants that have been denied these CUPs, while meeting all the criteria, could have legal recourse against the City. Litigation is expensive and unnecessary if the planning commission abides by Avalon's Municipal Code.
